Foundation Files Motion to Dismiss US Metals Suit - December 15, 1999 On November 18, 1999, the Lemelson Foundation filed a motion to dismiss in the suit brought by US Metals concerning title to the Lemelson patents. The key motion makes five separate arguments, including one based on the language of the alleged agreement itself. The motion is available for download in the "Litigation Documents" section of the site. Foundation Wins Issue Re Scope of Texas Instruments License - October 27, 1999 In the Intel case, Judge H. Russel Holland has rejected a license defense asserted by Texas Instruments. In the same opinion, he denied TI's motion for non-infringement based on the license. Gorton has dismissed the declaratory judgment action filed by Cognex in Massachusetts for lack of personal jurisdiction over the Lemelson Foundation. The opinion, which can be found at 1999 U.S. Dist. LEXIS 14798 (Sept. 21, 1999), notes that Cognex only asserted general jurisdiction over the Foundation. The court concluded that the Foundation's "cease and desist" letters sent to Massachusetts were insufficient to create general jurisdiction. UPDATE: On September 29, 1999, Cognex re-filed the suit in Reno. Lemelson Foundation Claims 400th Licensee - September 24, 1999 The Lemelson Foundation announced today that it had signed its 400th licensee to the portofolio of patents listed Jerome Lemelson as an inventor. The Foundation considers the list of licensees "confidential" but has made it widely available to companies engaged in settlement negotiations. If you or your company has been approached by the Foundation and you have not seen the licensee list, be sure to ask the Foundation for a copy.
